This Privacy Policy describes privacy practices of Brooke Chase Associates, Inc. regarding the collection, use and worldwide transfer of personal information collected through our web site, as well as personal information gathered by Brooke Chase Associates, Inc. in relation to the provision of executive search and recruitment services (“Search Services”). By using our services and web site, you signify your agreement to the terms and conditions of this Policy. If you do not agree to this Policy, please do not use our services or web site.

Any changes to our Policy will become effective upon posting of the revised Policy on the Internet, accessible through our web site. PERSONAL INFORMATION WE COLLECT

Brooke Chase Associates, Inc. collects personal information (such as name, e-mail address and physical address) and other information that visitors to our web site choose to provide to us. For example, information provided when a visitor registers as a candidate for our Search Services, uploads or builds a candidate fact sheet, responds to employment opportunities posted on our web site or takes an online assessment. Such personal information may include your (User) ID, password, the pages visited, and the duration of the visit to our web site. We also collect personal information when you contact us via email or postal mail.

In the course of the various Search Services that we provide, we may collect the following personal information: name, address, telephone number, e-mail address, resume information (e.g., employment history, education, job qualifications, ability to relocate, professional credentials, memberships in professional organizations, skills, language skills, hobbies), citizenship, information from former employers and other references, and any other information relating to you, to the extent we have acquired or you have provided us with such information. We encourage you not to provide sensitive information to us. To the extent that you elect to include sensitive information on your resume or candidate fact sheet, we will retain that information. In the U.S. we may collect personal information related to race and gender for diversity purposes.

HOW WE USE AND DISCLOSE THE INFORMATION WE COLLECT

The following paragraphs describe various specific ways in which we may use and disclose personal and other information:


(1) Personal Information Concerning Candidates

  • IDENTIFYING POSITIONS OF INTEREST. We use personal information that we have collected concerning candidates to identify professional opportunities that we think may be of interest. We may contact potential candidates from time to time regarding such opportunities.
  • PROVIDING INFORMATION TO PROSPECTIVE EMPLOYERS. We provide personal information regarding candidates to prospective employers only after the individual has agreed to become a candidate for a search.  Your information will never be revealed without your prior approval. 
  • SOLICITING INFORMATION REGARDING CANDIDATES. We may contact individuals from time to time to solicit names or other personal information regarding potential candidates in connection with a search that we are conducting.
  • REFINING OUR SEARCH SERVICES. We may use personal information that we collect concerning candidates for purposes of developing and improving our Search Services, and, in the U.S. and Canada for purposes of collecting and disclosing diversity statistics and other statistical information regarding our candidates and placement activities.


(2) Personal Information Concerning Clients

 We collect personal information pertaining to our clients, including business contact information, and retain and use such information in providing our Search Services. We may contact you from time to time regarding your needs and the services that we provide.

(3) Other Uses of Personal Information

  • UPDATING YOUR DATA. We may contact you from time to time to ensure that the personal information we have collected about you is accurate and current.
  • RESPONDING TO YOUR INQUIRIES. If you contact us by e-mail or through our web site, we may keep a record of your contact information and correspondence, and we may use any contact information you provide in your message to respond to your inquiry.
  • OTHER COMMUNICATIONS. Brooke Chase Associates, Inc. may from time to time send informational or promotional emails concerning its Search Services.
  • MODIFICATION, IMPROVEMENT, REFINEMENT AND VALIDATION OF INTELLECTUAL PROPERTY AND TECHNOLOGY. We use personal information to enhance our Search Services, and to further improve our technology to give you convenient access to our web site.
  • ACCOUNTS AND RECORDS. We may use personal information for background checks, only with your prior consent, for the purpose of obtaining information regarding credit, educational verification, driving and criminal records at the time of an offer by a client.  You will be asked to sign a Reference Release form before conductiing any background checks.
  • FOR PROPOSALS, ENGAGEMENT LETTERS, AND PRESENTATIONS. We occasionally may use personal information for proposals, engagement letters, and presentations.
  • FOR RESEARCH SURVEYS. We may use personal information such as e-mail or postal addressees to conduct surveys.
  • ADVERTISING, MARKETING AND PUBLIC RELATIONS. We may use personal information, only with your consent, for promotional activities, such as press releases.


DISCLOSURE TO AFFILIATES, CLIENTS, SERVICE PROVIDERS AND OTHERS

(1) Disclosure to affiliates and strategic alliance partners

Brooke Chase Associates, Inc. its affiliates, and strategic alliance partners jointly use the personal information submitted to us for the purposes stated above. Brooke Chase Associates, Inc. remains responsible for how the personal information will be used. If you would prefer not to have your personal information used by Brooke Chase Associates, Inc. please simply let us know by contacting us as indicated below and we will remove or suppress your personal information in our database.

(2) Disclosure to prospective employers 

We provide personal information regarding candidates to prospective employers for reference sources only if the candidate has authorized us to do so. 

(3) Disclosure to service providers

Brooke Chase Associates, Inc. works with third parties who provide services that may include, but are not necessarily limited to, assessment services, including assessment validation services; website hosting and IT consulting services; data analysis; resume verification; background checking; payroll services; public relations services; attorneys, accountants, and other administrative and back-up and security services. As part of providing those services, such third parties will be provided with access to personal information. In addition, our software development partners may use personal information for purposes of modifying, improving, refining and validating their technology, and research and development.

From time to time, we may contract with an e-mail marketing firm to perform a promotional mailing. We will provide the firm with a list of e-mail addresses of executives who have requested not to be contacted by Brooke Chase Associates, Inc. via e-mail, for purposes of suppressing emails to these individuals.

(4) Others

Brooke Chase Associates, Inc. may also disclose personal information in order to: (i) comply with applicable laws; (ii) respond to inquiries or requests from public or government authorities; (iii) comply with valid legal process; (iv) protect the rights, privacy, safety or property of Brooke Chase Associates, Inc. site visitors or the public; (v) permit us to pursue available remedies or limit the damages that we may sustain; (vi) enforce our Terms of Use; or (vii) respond to an emergency. We cannot and do not assume any responsibility for the actions or omissions of third parties, such as clients, including the manner in which they use personal information received either from Brooke Chase Associates, Inc. or from other independent sources.

(5) Business Transfers

Brooke Chase Associates, Inc. reserves the right to disclose or transfer, any and all personal information that we collect from visitors, or that we otherwise collect in connection with the Search Services, to a third party in connection with a strategic alliance with such third party, or in the event of a sale of our company or one of our affiliates, a merger or consolidation involving Brooke Chase Associates, Inc. or one of its affiliates, or a sale or transfer of assets or of any portion of our business or the business of one or more of our affiliates.

COOKIES AND OTHER TECHNOLOGIES

Our web site uses “cookies” — that is, small text files placed on a visitor’s computer hard drive — and other technologies to help us determine information such as the type of content to which a visitor to our web site links, and the length of time each visitor spends at any particular area of our web site. Brooke Chase Associates, Inc. cookies are only read by Brooke Chase Associates, Inc. servers and are unable to execute any code or virus.

Brooke Chase Associates, Inc. may from time to time sponsor special features or promotions on our web site and additional privacy information may be posted. That privacy information, to the extent it conflicts with this Policy, will govern that particular feature or promotion.

CHOICE AND ACCESS

The provision of personal information by you is entirely voluntary and you have the right not to provide personal information. You may also contact us at lbendele@brookechase.com if you wish to receive certain information as to whether or not personal information relating to you is held by us and to obtain a copy of such information.

You may request to be removed from Brooke Chase Associates, Inc.’s database simply by sending an email to lbendele@brookechase.com which includes your full name and telephone number in the body of the e-mail message. We will use reasonable reports to comply with your request. (We may need to contact you in order to be sure that we are deleting the appropriate information.) Please keep in mind that residual information will remain within Brooke Chase Associates, Inc. databases, access logs and other records, which may or may not contain personal information about you. The residual information will not be used for commercial purposes. However, Brooke Chase Associates, Inc. reserves the right, from time to time, to recontact former users of our Search Services.

LOCATION OF PERSONAL INFORMATION COLLECTED AND MAINTAINED

This site is hosted in the United States. By providing personal information and other information through our web site, you understand and consent to the collection, use, processing, disclosure and transfer of such personal information to the United States.

Brooke Chase Associates, Inc. has security measures in place to protect against the loss, misuse and alteration of personal information about site visitors which is under our control.
